Guam Divorce – An Overview

A divorce on Guam is a convenient alternative for individuals who wish to become legally divorced in a rapid and convenient manner in a U.S. jurisdiction. Individuals who have been utilizing Guam to obtain a divorce include, but are not limited to, U.S. military personnel; couples living or working outside the U.S.A.; couples who live in a U.S.A. political jurisdiction where divorce requirements are burdensome, time consuming, and expensive; and citizens of non-U.S.A. countries who can freely enter Guam pursuant to U.S.A. immigration laws.

Key Positive Legal Features

1. The residency requirement to obtain a Guam divorce is seven (7) days, provided the divorce papers are signed by both parties, thus making it an uncontested, or stipulated to, divorce. Once the case is filed it routinely concludes with a Final Decree of Divorce in approximately two (2) to four (4) weeks. See: 19 Guam Code Annotated Section 8318 (a) and (b), attached.

2. The residency requirement for a contested divorce is ninety (90) days. If your spouse will not consent to a divorce, or if you are unable to locate or contact your spouse, Guam law still allows you to obtain a divorce.

3. Guam is an unincorporated territory of the U.S.A. It was ceded to the U.S.A. by Spain, pursuant to the Treaty of Paris which ended the Spanish American War of 1898. The Guam government including its judicial/court system was established by law of the U.S. Congress. A divorce granted by a Guam Court including property and custody agreements, is legally recognized by all political jurisdictions of the U.S.A. See: U.S. Code, Title 28, Section 1738, attached.

1. Uncontested divorce for non-resident/off-island residents rate: $1,000.00 for professional consultation and services. $300.00 for filing fee. Total: $1,300.00

2. Contested divorce for non-resident/off-island resident rate $200.00 per hour plus court costs. Retainer required minimum $2,000.00.
